As purchasing clothes online is not an exact science, you may find yourself with an item you wish to return. Below are the easy steps you must follow in order to exchange or return an item.

Important!

The Return Form or Exchange Form (the “Form”) must be completed no longer than 10 days after you have received your purchase . Any Exchange/Refund requests received after that deadline will be automatically refused.

Items to be returned must be unworn, unwashed, unaltered and free of any damage. All tags must be attached, including the refund tag that can be found at the back of the items. Please safeguard the original packaging as it will be required for the Exchange/Refund.

A restocking fee of $15 per transaction is applicable on all Exchanges/Refunds. Initial shipping charges, if any, are non refundable.

Items marked “Final Sale” cannot be returned nor exchanged.

We do not accept returns from outside the U.S. or Canada.

Exchange/Refund procedure

Please visit our Online Store, click on Exchange Form or Return Form, as the case may be, and complete it by entering your order number and your first name.

Once your initial order has been identified, select the new size you wish to receive for an exchange or select the product you wish to return .

Upon reception and approval of your request, Mackage Customer Care will send you an email with a FedEx return label. Print the label and attach it to the original packaging of the item. Within 5 business days, drop off your package at your local FedEx drop-off center or call the number on the instruction sheet to arrange a pick-up. Any parcel drop off or pick-up after 5 business days will result in the cancellation of the Exchange/Return and the package will not be accepted at our warehouse.

Once we receive your package in our warehouse, your refund will be processed in the original form of payment within 5 business days. You will be notified by email when the refund has taken place. Please note that your bank may require additional processing time before crediting your account.

5. PRICE

All prices quoted are payable in Canadian Dollars for purchases made on the Canadian online store and in US Dollars for purchases made on the US online store. Although Soïa & Kyo strives to provide accurate product and pricing information, errors may occur. Soïa & Kyo reserves the right to correct any errors in pricing or product information and to modify the prices of Products, at any time, without prior notice. 7. PRODUCT AVAILABILITY

The availability of certain Products may be limited, and Products may not be available for immediate delivery. Soïa & Kyo may revise or cease to make available any Products at any time without prior notice. In the event that Soïa & Kyo is unable to deliver to you a Product ordered due to lack of availability, Soïa & Kyo will notify you via e-mail and your order will be automatically cancelled with respect to such unavailable Product, provided that Soïa & Kyo may, in its sole discretion, contact you in order to allow you to maintain your order subject to a revised delivery time if and when the Product becomes available.

The products available for sale and/or distribution by Soïa & Kyo are available only in Canada and the U.S.A, depending on the online store selected.

8. SHIPPING; TAXES

Soïa & Kyo will ship the Product(s) ordered by you according to the delivery method you have chosen and to the address indicated in the Order Confirmation. For your information, Fedex requires, upon delivery, an adult signature as a proof of delivery so please ensure someone is available to receive the parcel on your behalf. Soïa & Kyo WILL ONLY SHIP PRODUCTS TO ADDRESSES LOCATED IN CANADA FOR PURCHASES MADE ON THE CANADIAN ONLINE STORE AND ONLY TO ADDRESSES LOCATED IN THE UNITED STATES OF AMERICA FOR PURCHASES MADE ON THE U.S. ONLINE STORE. Delivery times provided by Soïa & Kyo are estimates only. Soïa & Kyo shall not be responsible for any damages or costs resulting from any delays in delivery.

Unless otherwise stated, all prices quoted do not include shipping and handling charges and, when applicable, federal and provincial sales taxes. Separate charges for shipping and handling and taxes will be shown on the Order Confirmation for each Order, as applicable. You are responsible for all sales, use, goods and services, harmonized sales, and other taxes and duties associated with the Order.

9. OWNERSHIP; RISK OF LOSS

All Product(s) purchased from Soïa & Kyo are delivered to you by a third party delivery company, pursuant to a shipping contract. You shall become the owner of the Product(s) and shall assume the risks of loss at the time of delivery by Soïa & Kyo of the Product(s) to the third party delivery company.

10. RETURNS & EXCHANGE

All Product returns are subject to Soïa & Kyo’s Return & Exchange Policy, the terms of which are incorporated herein by reference. Some restrictions may apply.

11. EXCLUSION OF WARRANTIES AND LIMITATION OF LIABILITY

Except as expressly provided for in this Agreement, Soïa & Kyo does not make or give any representation, warranty or condition of any kind, whether express or implied, statutory or otherwise, including without limitation warranties as to uninterrupted or error free transactions, privacy, security, merchantability, quality, title, durability, suitability, non-infringement or fitness for a particular purposes, or those arising out of a course of dealing or usage of trade.

In no event will Soïa & Kyo be liable for any indirect, incidental or consequential damages, howsoever caused, including but not limited to, any lost profits, lost savings, loss of use or lack of availability of facilities including computer resources, routers and stored data, punitive, exemplary, aggravated or economic damages, arising out of the products provided by Soïa & Kyo or otherwise related to this Agreement or the transactions conducted on or from the www.soiakyo.com website, even if Soïa & Kyo or any of their lawful agents, contractors, employees or mandataries have been advised of the possibility of such damages or claim. In no case will Soïa & Kyo’s total liability arising under any cause whatsoever (including without limitation breach of contract, negligence, gross negligence or otherwise) be for more than the amount paid by you for the specific products ordered under this agreement and to which the claim relates. In no event will Soïa & Kyo be liable to you for damages or losses resulting from viruses, data corruption, failed messages, damages arising as a result of: transmission errors or problems, telecommunications service providers, Soïa & Kyo’s contractors, the Internet backbone, third-party suppliers of products or services, damages or losses caused by you, or your respective employees, agents, mandataries or subcontractors, or other events beyond the reasonable control of Soïa & Kyo.

Certain federal or provincial laws, as applicable, may not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you might have additional rights.
For the purposes of this Section, “Soïa & Kyo” shall include Soïa & Kyo’s affiliates and Soïa & Kyo’s and its affiliates’ respective directors, officers, employees, agents, mandataries and contractors.

This Section shall survive the termination or expiry of this Agreement.

12. GOVERNING LAW AND JURISDICTION

This website and its server are physically located within the Province of Quebec, Canada. This Agreement shall be construed and interpreted in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein and shall be treated in all respects as a Quebec contract, without reference to principles of conflict of law. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

13. EXPORT LAWS

Products sold or delivered under this Agreement shall be subject to (i) the export control laws and regulations of Canada, when a Product has been purchased through the Canadian online store, or (2) to export control laws and regulations of the United States of America when a Product has been purchased through the American online store. You agree to comply at all times with all such laws and regulations. You will defend and hold Soïa & Kyo harmless against all claims, damages or liability resulting from breach of the foregoing.

14. HEADINGS

The headings of this Agreement are inserted for convenience of reference only and do not affect the construction or interpretation of this Agreement.

15. NO ASSIGNMENT

You may not assign your rights or obligations under this Agreement without the express written consent of Soïa & Kyo.

16. SUCCESSORS AND ASSIGNS

This Agreement shall inure to the benefit of and be binding upon each of the parties hereto and their respective successors and permitted assigns.

17. SEVERABILITY

The provisions of this Agreement shall be deemed severable. In the event that any provision of this Agreement is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

18. ENTIRE AGREEMENT

This Agreement, together with all other agreements, terms or conditions incorporated or referred to herein constitute the entire agreement between you and Soïa & Kyo relating to the subject matter hereof, the use of this website and any transactions conducted on or from this website, and supersede any prior understandings or agreements (whether electronic, oral or written) regarding the subject matter hereof, and may not be amended or modified except in writing, or by Soïa & Kyo making such amendments or modifications available to it pursuant to this Agreement.

19. NO WAIVER

The failure of Soïa & Kyo to enforce any provision of this Agreement or to respond to a breach by you or any third party of this Agreement shall not in any way waive the right of Soïa & Kyo to subsequently enforce any of the terms and conditions contained herein or to act with respect to similar breaches.

20. ENGLISH LANGUAGE

How to shop online?

Shopping online is easy. Once you have selected the item you wish to purchase, you can add this item to your shopping bag by clicking on the “add to your bag” button located at the bottom right corner of any page. At any moment during your transaction, you may view the items you have added to your bag by clicking the "view shopping bag" button on the top right corner of any page. Once you are ready to checkout with the items in your shopping bag, click on the “checkout” button in your shopping bag window. At this point, you will need to complete your shipping and billing information and follow-up with your credit card information to confirm your purchase.

Item availability

Although we make every effort to keep sufficient stock of items listed on our site, occasionally we do sell out of certain products. If we are out of stock on an item that you wish to order, a pop-up message will notify you automatically as you click on the sold-out item. When we intend on replenishing a sold-out item, a different pop-up message will ask you to provide us with your email address so that we can notify you when we have received the coat you wanted.

Do you have sizing information?

We have added a size chart link to every shopping page. Please refer to it to help determine your size when ordering from Soïa & Kyo. Since sizing and cut may vary between styles, please use this chart as a general guide. Please note that your body type may fit, according to our sizing chart, between two sizes and at that point, you have to decide whether you want to have that extra space for a thick winter sweater that you would like to wear underneath or whether, on the contrary, you like that extra fitted feel.

Which credit cards do you accept?

For purchases made through the canadian online store, we accept Visa, MasterCard and American Express. For purchases made through the US online store, we accept Visa and MasterCard only.

Do you charge sales tax?

For orders shipped within Canada, sales taxes are charged and the rate varies depending on the "ship to" address (depending on the Province/Territory). For orders shipped within the US, sales taxes are charged only on orders shipped to the State of New York and the State of Florida.

How can I modify my order?

If you wish to modify or cancel your order, please email us at shop@soiakyo.com as soon as possible so that we can try to reasonably accommodate your request before the parcel has been processed and shipped.

Does the Soïa & Kyo online store ever go on sale?

Please note that the Soïa & Kyo online store was set-up in order to serve clients that do not have easy access to our retailers or clients who would like a specific color /size/ style that retailers in their area do not carry. In order to not unfairly compete with our retailers, our website policy is to sell at full retail price at all times.

Do you ship to where I live?

Soïa & Kyo ships within Canada and the US only. Unfortunately, we do not ship to international addresses at this time. As an alternative, we suggest to our international clients to have the coat shipped to a friend or a relative living in Canada/US and have that person, in turn, ship the coat to its final international destination.

As for returns and exchanges, please note that each package delivered by us contains a pre-paid Fedex return label and therefore you do not have to pay to return the coat back to us, for whatever reason that may be. However, we do charge a $15 re-stocking/ handling fee for merchandise returned/ exchanged.
Please note that we are unable to deliver to P.O. Boxes and we do not offer Saturday and Sunday deliveries.

What if I am unavailable during the day to receive my package?

Please contact FedEx at 1-800-463-3339 to schedule an appointment. Please have your order information as well as your tracking number with you when you call Fedex.

How can I track my order?

A shipping confirmation e-mail will be sent to your email by Fedex once your box has been picked-up by Fedex from our warehouse. This e-mail confirmation will include the tracking number for your package. You may track the status of your order at anytime by visiting the FedEx website at http://www.fedex.com.

What is your return policy?

Returns and exchanges are accepted on merchandise within 10 days of receipt for items that HAVE NOT BEEN WORN, ALTERED OR WASHED and with ALL tags attached (including the refund tag attached at the back of the coat). The Return Form or Exchange Form, as applicable, must be completed first. directly on our website in the designated section. PLEASE NOTE: Shipping charges are non-refundable and a $ 15 re-stocking/handling fee is applicable on all returns and exchanges.

How do I return or exchange an item?

Using your order confirmation number and your first name, complete the Return Form or Exchange Form, as applicable, on our website. The Return Form or Exchange Form, as applicable, must be completed as soon as possible and no later than 10 days after you have received your coat (this delay is determined based on the delivery date tracked by Fedex). The system will not accept a form completed past the 10-day deadline. Once you have completed the Return Form or Exchange Form, as applicable,, simply follow the instructions that you will receive by email. Please securely pack and seal the returned merchandise.

When will my credit card be refunded?

Once your package has been received at Soïa & Kyo, your refund will be processed in the original form of payment (i.e. same credit card) within five business days. You will be notified, via email, at the email address listed on your invoice when the refund has taken place. Please note that your banking institution may require additional days to process and credit this transaction to your account once it has received the refund confirmation from Soïa & Kyo.
